MINUTES OF THE OPEN SESSION MEETING OF
THE TEANECK TOWNSHIP COUNCIL
HELD IN THE MUNICIPAL BUILDING COUNCIL CHAMBERS ON
WEDNESDAY, MAY 12, 2010


Mayor Feit called the Open Session Meeting of the Teaneck Township Council to order at 8:11 p.m., and asked all those present to rise for the Pledge of Allegiance.

ROLL CALL

Present: C. Gussen (arrived at 8:14 p.m.), C. Hameeduddin, DM. Parker, C. Honis, C. Katz, C. Toffler, Mayor Feit.

Absent: None. 

Also Present. S. Turitz, Ferrara, Turitz, Harraka & Goldberg Esqs.; W. Broughton, Township Manager; L. Aportela-Hernandez, Municipal Clerk, I. Abbasi, Executive Assistant.

MAYOR'S ANNOUNCEMENT

Adequate notice of this meeting has been provided by Resolution 322-09, setting the 2010 meeting dates, and Resolution 87-10 amending the 2010 meeting dates, sending a copy to THE RECORD, THE SUBURBANITE, THE BERGEN NEWS/SUN BULLETIN, THE JEWISH STANDARD, and THE COUNTY SEAT, filing a copy in the Township Clerk's Office and posting it on the Municipal Building bulletin board, and the Mayor hereby directs that this statement be included in the minutes.

Mayor Feit advised that Council just received the auditor's report.  Mr. Turitz confirmed that since Council has not had the opportunity to review the recommendations, it is still deliberative material.  He advised that said material can be released to the public once the Council has conducted their review and the auditor will be present tomorrow night.  Mayor Feit that there will be no discussion on the particulars of the school budget during tonight's meeting.

MEETING OPEN TO THE PUBLIC FOR GOOD AND WELFARE OR PUBLIC INPUT ON ANY MATTERS ON THIS AGENDA

Mayor Feit inquired whether any member of the Council has any comments prior to opening the meeting to any comments from the public.

Mayor Feit explained the budget process over the past few months and advised of the documents that are available on the Township website. 

Mr. Broughton advised that initially, the budget was proposed with a 4.8% tax levy, which was reduced to 4.3% during Council's review, but that due to the loss of state aid, the tax levy increased to 4.8%, which is approximately $207 increase on the average assessed home.

Mayor Feit declared that any members of the public wishing to be heard at this time shall come forward and state their names and addresses for the record.  Comments shall be limited to five minutes per person.

Joan Davis - 976 Alpine Drive - stated that the budget increased since last year and there was nothing to show for it; questioned the sidewalk repairs on Teaneck Road; mentioned recycling and use of trash receptacles; expressed her hope that Council does not go through with the synthetic turf project; and commented on the availability of health care through NJFamilycare.org.

Howard Rose - 575 Northumberland Road - congratulated all the participants of the municipal election and requested clarification on the impact of the tax rate.

Charles Powers - 1374 Academy Lane - inquired how the spending plan will be altered if any portion of state aid is reinstated.

Genevieve Maiberger - 89 Bogert Street - hopes to see a cordial relationship with the new Council and requested that the Township pay to maintain the burial ground.
There being no further persons wishing to speak at this time, Mayor Feit declared that the public comment portion of the meeting is now closed.

Mayor Feit inquired whether any member of the Council wishes to respond to the public comments.

Mayor Feit explained that it is possible that the legislature may return state aid and the Township has the option to transfer funds at the end of the year or roll over to the fund balance.  There will be no returns in the form of a rebate.  Council also has the option of modifying the budget.

Mr. Broughton stated that the Township will cut the grass and maintain the burial ground.  The sidewalk replacement on Teaneck Road is being done by grant money for wheelchair accessibility.

DM. Parker clarified that a resident is paying someone to maintain the burial ground.

INTRODUCTION OF THE 2010 BUDGET

C. Gussen made a motion to introduce the 2010 Budget and setting June 15, 2010 at 8:00 p.m. or as soon thereafter as the matter may be reached as the date and time and Municipal Building Council Chambers as the place for a hearing on said Budget.   Seconded by DM. Parker.

Resolution 111-10 - Approving the Introduction of the 2010 Budget.

Resolution 112-10 - Authorize Submission of Budget to Director of Local Government Services.

Mayor Feit inquired as to whether any Councilmember wishes to comment upon the motion to introduce.

There were no comments.

There being no further comments, Mayor Feit called on the Clerk for a roll-call vote.

In Favor: C. Gussen, C. Hameeduddin, DM. Parker, C. Honis, C. Katz, C. Toffler, Mayor Feit.

Opposed: None.

Absent:  None. 

Mayor Feit declared that the 2010 Budget is duly introduced.

INTRODUCTION OF ORDINANCES

C. Toffler made a motion that the following Ordinances be introduced and passed on first reading and that the Clerk is hereby authorized and directed to publish the required legal notice of the introduction thereof, together with a notice of the place, time, and date on which a public hearing will be held on said ordinance, and on which said ordinances will be considered for final adoption.

ORDINANCE #4183 - AN ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK.

Seconded by C. Honis.

Mayor Feit inquired as to whether any Councilmember wishes to comment upon the motion to introduce.

C. Gussen excused himself due to one of his children being injured and left the meeting at 8:41 p.m

There being no further comments, Mayor Feit called on the Clerk for a roll-call vote.

In Favor: C. Hameeduddin, DM. Parker, C. Honis, C. Katz, C. Toffler, Mayor Feit.

Opposed: None.

Absent:  C. Gussen

Mayor Feit declared that said ordinance is duly introduced and passed on first reading.


ADJOURNMENT

C. Katz  moved to adjourn the Open Session Meeting at 8:43  p.m.  Seconded by Mayor Feit.
